Jewellery Claim Can Be Enforced Before Divorce Is Final: Court of Cassation Ruling

A court order for the return of wedding jewellery can be sent straight to debt enforcement proceedings — even before the divorce itself becomes final. A ruling by the 12th Civil Chamber of the Court of Cassation (Yargıtay 12. Hukuk Dairesi), reported publicly on 17 October 2026, confirms that a woman awarded her wedding gold does not have to wait for appeal (Bölge Adliye Mahkemesi) or cassation appeal proceedings to run their course before enforcing that part of the judgment. This article explains what the ruling changes, which parts of a divorce judgment still require finality before enforcement, and what options the paying party has.

What did the 12th Civil Chamber decide?

The case arose from a dispute over wedding jewellery after a couple divorced. The family court, hearing the jewellery claim alongside the divorce proceedings, found in the wife’s favour and ordered that the jewellery be returned (or its value paid). When her ex-husband refused to comply, she launched debt enforcement proceedings (ilamlı icra takibi) against him.

The ex-husband argued that because the divorce judgment had not yet become final, any ancillary order made within those same proceedings — including the jewellery award — must also await finality. The enforcement court (icra hukuk mahkemesi) rejected his objection; the 8th Civil Chamber of the Regional Court of Appeal (Bölge Adliye Mahkemesi) dismissed his appeal; and the Court of Cassation’s 12th Civil Chamber upheld that outcome.

The court’s core reasoning: a jewellery claim decided within divorce proceedings does not alter either party’s personal or family status — it affects only their assets. It is therefore not an ancillary order dependent on the divorce itself, but a freestanding order to perform (eda hükmü), enforceable like any other money or property judgment without waiting for finality. The same logic applies to the court costs and legal fees awarded in connection with the jewellery claim.

Why is a jewellery claim not treated as part of the divorce order?

The Turkish Code of Civil Procedure (Hukuk Muhakemeleri Kanunu — HMK) provides that orders touching personal or family status cannot be enforced until they become final: Art. 350/2 HMK for regional appeal and Art. 367/2 HMK for cassation appeal. The divorce order itself, child custody and contact arrangements all fall within this rule. In practice, the financial compensation (damages) awarded because of the divorce, and the court costs and legal fees linked to the divorce order, are treated as ancillary to it and follow the same rule — the Court of Cassation reaffirmed this in the same ruling.

Wedding jewellery stands on different legal ground. Under established Court of Cassation practice, gold and jewellery given to a bride at a wedding is treated as her personal property (Turkish Civil Code (TMK) Art. 220 — similar in function to ‘separate property’ under many matrimonial property regimes). The claim is therefore essentially a claim for the return of an asset or payment of its value. Even though it is heard as part of the divorce case, the right does not depend on the divorce outcome. A jewellery claim is also legally distinct from a claim for division of assets; disputes about the matrimonial property regime (edinilmiş mallara katılma — the default participation-in-acquired-assets regime that has applied in Turkey since 2002) follow their own procedural rules.

Which parts of a divorce judgment can be enforced before finality?

Taking this ruling together with the principles it restates, the different heads of a typical divorce judgment broadly break down as follows:

Head of judgment Finality required? Notes
Divorce order Yes Relates to personal/family status; cannot be enforced until final.
Child custody and contact Yes Personal and family law order.
Compensation (damages) awarded because of the divorce Yes Treated as ancillary to the divorce order.
Court costs and legal fees linked to the divorce order Yes Treated as ancillary to the divorce order.
Jewellery claim and related court costs and legal fees No Freestanding enforcement order; can be enforced before finality.

This distinction matters most when appeal or cassation appeal proceedings drag on for months or even years. You — as the person awarded your jewellery — no longer have to sit and wait while those stages run their course.

How do you start enforcement proceedings for a jewellery claim?

The order will typically read something like: “return of the jewellery in kind; if return in kind is not possible, payment of its value.” To enforce it, you take a certified copy of the judgment to the enforcement office (icra dairesi) and open enforcement proceedings based on a court order (ilamlı icra). It is important to follow the exact wording of the order: if it requires return in kind, enforcement must proceed on that basis; you can only switch to a monetary claim once the conditions set out in the judgment are met. No certificate of finality is needed for the jewellery part. However, if the judgment also contains divorce-linked heads of award, your enforcement application should specify only the jewellery claim and its associated costs — this avoids unnecessary objections from the other side.

What options does the paying party have?

The fact that enforcement can begin before finality does not leave the paying party without protection. Art. 36 of the Enforcement and Bankruptcy Code (İcra ve İflas Kanunu — İİK) allows a party who has lodged an appeal to apply for a stay of enforcement (tehiri icra) by providing security. Once the security is in place, the enforcement office gives a deadline to obtain the stay order from the appellate court.

There is also a safeguard running the other way: if an order that has already been enforced is later overturned, Art. 40 İİK requires the enforcement to be reversed — any money paid or property handed over must be returned to the paying party. So if you are the party who has received payment under a judgment that has not yet become final, you should keep in mind that a successful appeal could require you to repay it.

Complaints procedure and time limits

In the case that prompted this ruling, the paying party challenged the proceedings on the ground that enforcement had been started before the divorce was final. The Court of Cassation noted that an objection of this kind is treated as a complaint (şikâyet) that is not subject to a fixed time limit (süresiz şikâyet). That said, given the court’s clear reasoning, any complaint based solely on the absence of a certificate of finality for a jewellery claim is unlikely to succeed.

What does this mean for divorce cases in Alanya?

Family courts in Alanya regularly deal with divorces where one or both parties are foreign nationals. In these cases, collection can be complicated by factors such as one spouse moving abroad, assets being held in different countries, or lengthy appeal proceedings. The ability to enforce a jewellery award immediately — without waiting for finality — means you can take steps against Turkish assets at a much earlier stage.

In an uncontested divorce, the parties can — and should — deal with the jewellery expressly in the settlement agreement. Leaving it out of the agreement is likely to give rise to a separate dispute later. Similarly, the legal treatment of assets acquired after the divorce petition is filed is different from that of wedding jewellery, and the two issues need to be considered separately.

Key points to keep in mind

  • Enforcement without waiting for finality applies only to the jewellery claim and the court costs and legal fees awarded in connection with it — compensation linked to the divorce itself still requires the judgment to be final.
  • The case reference has not been published in press reports; if you need the full text of the ruling, check the Court of Cassation’s own case-search system.
  • Because an overturned judgment triggers a reversal of enforcement under Art. 40 İİK, bear in mind the risk of having to repay if you collect under a judgment that is still subject to appeal.
  • The paying party can apply for a stay of enforcement by providing security under Art. 36 İİK — this option is available for jewellery claims just as for any other enforcement order.
