How Can Legal Uncertainties in Recognising Foreign Divorce Decisions in Turkey Be Resolved?

The process of recognising foreign court decisions in Turkey is complicated by the complexity of administrative and judicial procedures and their openness to different interpretations, which can lead to legal uncertainties. The limits on judicial review of administrative authority decisions (such as those made by population registry offices) and the broad interpretation of the public policy concept create various practical problems. In this context, future research could focus on developing mechanisms that will increase coordination between administrative and judicial processes, define the public policy concept more clearly, and encourage alternative dispute resolution methods. Additionally, by using artificial intelligence-assisted decision support systems and expert systems, it may also be possible to improve and accelerate the processes for assessing compatibility between foreign legal systems and practices in Turkey. Such innovative approaches could make the process of recognising foreign divorce decisions in Turkey more transparent, predictable and effective.
