Power of Attorney (PoA)

A power of attorney (PoA) is a legally binding document that authorises another person — your representative — to act on your behalf in defined legal matters. It must clearly set out the scope of the authority granted, be based on mutual trust, and comply with the formal requirements prescribed by law.
In plain terms, a PoA is the notarised document that gives someone the legal standing to act as your attorney-in-fact. In Turkey, only two types of authority can issue a valid PoA: a Turkish notary public (noter) and Turkish Embassies or Consulates abroad. Foreign authorities may also issue a PoA in accordance with their own national law.
Documents issued by the authorities listed in Article 61 of Law No. 1111 are accepted as a PoA, but only for a period of up to two months.

If you want to appoint a lawyer in Turkey, you must do so by means of a notarised power of attorney — a written PoA without a notary’s stamp is not considered sufficient on its own.
For Turkish citizens, both notaries in Turkey and the notarial departments of Turkish Consulates abroad keep standard PoA templates ready to use. Once the appropriate template has been identified, your details and those of your lawyer are filled in, and you sign the document before the notary. The fee is then calculated based on the length and complexity of the document — shorter, straightforward PoAs cost less, while longer, more detailed ones cost more. The notary fee for a standard lawyer’s PoA was in the range of 100–250 TL in 2021, rising to 490 TL in 2024.

For divorce proceedings, recognition and enforcement of a foreign divorce judgment in Turkey, and any real estate-related PoA, your photograph must also be attached to the document and officially certified by the notary.
Foreign nationals who wish to appoint a lawyer in Turkey must meet exactly the same requirements as Turkish citizens. This means you can grant a PoA before a notary public in your own country in favour of a Turkish lawyer. However, there is one additional step: the PoA issued by a foreign notary must be endorsed with an Apostille stamp by the competent authority in that country. This is because documents issued by foreign official bodies are only recognised as valid in Turkey once the Apostille certification has been obtained — much like the process familiar to many EU residents when authenticating documents for use abroad.
Foreign nationals who wish to have a PoA drawn up in Turkey or at a Turkish Consulate abroad are also catered for. If you are in Turkey, you must attend the notary together with a sworn interpreter; if you are abroad, you must use an interpreter recognised by the relevant Consulate. The interpreter translates your personal details to the notary and also explains to you, in your own language, the exact scope of the authority you are granting. The interpreter’s details and signature appear on the PoA itself.
Power of Attorney in Alanya, Turkey: In our view, the requirement for notarisation every time a lawyer is appointed in Turkey is outdated and deserves serious debate. In the fast-moving world of business and litigation, it works against both clients and lawyers alike. From the client’s perspective, notary fees, travel costs and lost time amount to hundreds of millions of lira every year across the country — and, most importantly, it creates a real barrier to accessing justice. From the lawyer’s perspective, it delays the start of proceedings unnecessarily.
Whether you are a Turkish citizen or a foreign national, it should be sufficient for you to read the PoA text prepared by your lawyer and simply sign and hand it over. Lawyers should then be able to act on that basis before courts and other official bodies. To guard against potential misuse, strict sanctions on lawyers who abuse the system would be a far more proportionate safeguard. At the same time, the notarisation requirement could reasonably be retained for specific high-stakes transactions outside classic litigation work — such as the transfer of real estate and similar matters.

In Germany — a country with a highly developed legal system that exports legal concepts to many other nations, including Turkey — notarisation is not generally required to appoint a lawyer. A written power of attorney signed by the client is sufficient.

How is a power of attorney granted to a lawyer?
Before a notary public or Consul, the following must be recorded:
– Full name – Signature – Address – Place of execution – Date and daily serial number.
If the person granting the PoA is themselves a lawyer, the document must also include their bar identity card details, along with their address.

A photograph of the person granting the PoA — showing their current appearance and suitable for identification purposes — must be securely affixed and stamped.
Photographs attached only with a staple are not accepted; they must be properly glued and certified.
Where the PoA is granted on behalf of a legal entity (such as a company), attaching a photograph is not required.

Any corrections or amendments made to the PoA must be initialled and stamped by the issuing authority.
Where a sub-power of attorney (a PoA derived from an existing PoA) is being granted, all pages of the original PoA must be copied and attached to the newly issued document.

The official seal used on the PoA must comply with the Seal Regulation published in the Official Gazette in 1984; PoAs bearing a plastic/rubber stamp are not accepted.
Where a copy of a PoA has been used by any Land Registry or Cadastre Office (Tapu Müdürlüğü), that office may certify and forward the copy to other offices, noting the name, title, date of certification and parcel reference, provided all pages have been presented.

  • A PoA issued by notarial offices in the Turkish Republic of Northern Cyprus (TRNC) does not require any further certification or legalisation. A bilateral agreement is in place under which documents certified by the competent authorities of the TRNC are treated by Turkish authorities as if they had been issued by Turkish bodies.
  • Under the Hague Convention, a PoA prepared in accordance with the issuing country’s national law and endorsed with the French-language <APOSTILLE> stamp (Convention de La Haye du 5 Octobre 1961) is accepted in Turkey without any additional approval from the Turkish Consulate in that country.
  • For PoAs issued by notaries in countries that are not party to the Hague Convention, the notary’s signature on the document must be separately verified and approved by the Turkish Consulate in that country.
