GRANTING A POWER OF ATTORNEY TO A LAWYER

Documents Required to Grant a Power of Attorney (PoA) to a Lawyer:
To grant a power of attorney (PoA) to a lawyer, visit a notary public (noter) with your national ID or passport.

PoA for Divorce Proceedings — you will also need two passport-sized photographs. The words “DIVORCE PROCEEDINGS (BOŞANMA DAVASI)” and your spouse’s full name must be stated explicitly on the document.

PoA on behalf of a Company — you will need the company’s signature circular and authorisation document. If the authorised representative wants to grant a single PoA both on behalf of the company and in their own personal capacity, the phrase “on behalf of the company by proxy, in a personal capacity as principal (şirket adına vekaleten şahsı adına asaleten)” must be included.

All individuals and legal entities registered for tax purposes are required to provide their tax identification number.

Granting a Power of Attorney to a Lawyer in Turkey:

If you live abroad and need to grant a PoA to a lawyer in Turkey, the document must be prepared by the competent authority in your country of residence and bear an Apostille — as required under the Apostille Convention — before it will be recognised in Turkey.

What should you keep in mind when granting a PoA to a lawyer?

Unless you specify otherwise, a PoA does not expire automatically — it remains in force until formally revoked.

How do you revoke a lawyer’s PoA?

In most cases, a signed written agreement between the lawyer and client confirming that the representation has ended is sufficient; from that date onwards, either party acting contrary to the agreement may be held liable. For matters involving banks or the Land Registry Office (Tapu Müdürlüğü), it is safer to obtain a formal deed of revocation (azilname) from a notary public and serve a copy on the relevant institution.
